The use of any term or acronym in this software should not be regarded as affecting the validity of any trademark or service mark. The content from our web sites is for your personal use only and cannot be used for any commercial purposes without written permission from RouterSim, LLC.

Any Copyright or Trademark/Service Mark infringements discovered on or within our web sites, study guides, software, or services will be removed upon notification from the owner. Upon discovery, send email to customerservice@routersim.com. RouterSim Software is designed to provide an additional mechanism for self-study and preparation for various certification exams. All information, databases, Software, lab exercises and related information are provided on an "as-is" basis with no warranty or fitness implied. RouterSim, LLC shall have neither liability nor responsibility to any person or entity with respect to any loss or damages arising from the information contained on our web sites or from the use of any information or software.

Permitted uses of our software

You are granted the following rights in the software that is supplied to you via download or on CD:

Right to Install and Use. Our software is the sole intellectual property of RouterSim. RouterSim, LLC grants you the right to use ONE copy of the Software on a SINGLE computer for each license (installation) provided to you on the RouterSim Authorization Diskette or through Internet Authorization. This is enforced through per-computer Copy Protection.

Right to Modify. You may not modify our softwareand /or merge it into another computer program.

Right to Transfer. You may not rent, lend or lease our software. You may not copy and distribute our software to others for a fee or provided at no cost. You may not sell new and unopened software packages to others unless authorized in writing from RouterSim.

Any type of copying of the registered version of any product or software to another computer is prohibited by Copyright law or international treaties, and prevented through the use of per-computer Copy Protection. Any attempts to defeat the Copy Protection features incorporated into the Software is a violation of this License Agreement and applicable laws.

Network Learning Tools fee-based services

Services provided on our Network Learning Tools web site require you to pay a fee, as described in the specific conditions included where those Services are offered. You agree to pay all fees and charges that you incur. Unless otherwise noted, all currency references are in U.S. dollars. We may, upon notice if required by applicable laws, at any time change the amount of, or basis for determining, any fee or charge, or institute new fees or charges. All fees and charges are payable in accordance with payment terms in effect at the time the fee or the charge becomes payable.

Your conduct on our web sites

If you create an account on our web sites and purchase our products and services, you will provide us with true, accurate, current, and complete information. If you are using our Nework Learning Tools you also agree to exit from your accounts at the end of each session. We will not be responsible for any loss or damage that may result if you fail to comply with these requirements.

The technology and the software underlying our sites and the Services is the property of RouterSim, LLC. You agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying our sites or services. You agree not to modify the software underlying our sites in any manner or form or to use modified versions of such software, including (without limitation) for the purpose of obtaining unauthorized access to our sites.

You agree that you will not use our sites to take any of the following actions:

Interfere with or disrupt our web sites.

Impersonate any person or entity in the purchase and use of our products and services.

Take any action that imposes an unreasonable load on our web sites.

Engage in any illegal activities.

Indemnification

You hereby agree to indemnify, defend and hold RouterSim, LLC and all of our officers, directors, owners, employees, agents, information providers, affiliates, partners, and licensors harmless from and against any and all liability, losses, costs, and expenses (including attorneys' fees) incurred by any RouterSim, LLC in connection with any claim, including, but not limited to, claims for defamation, violation of rights of publicity and/or privacy, copyright infringement, or trademark infringement.

You are entirely responsible for maintaining the confidentiality of your licenses, passwords, and your account, as well as all activities that occur under your account. You hereby indemnify, defend, and hold us and our affiliates and our officers, directors, owners, agents, information providers, licensors, and licensees (collectively, the "Indemnified Parties") harmless from and against any and all liabilities and costs (including reasonable attorneys' fees) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these terms of use or claims arising from your account. You shall use your best efforts to cooperate with us in the defense of any claim. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

We disclaim any responsibility for the deletion, the failure to store, the misdelivery, or the untimely delivery of any information or material. We disclaim any responsibility for any harm resulting from downloading or accessing any information or material on the Internet using search results from our sites. We disclaim any responsibility for, and if you subscribe to one of our fee-based services you will not be entitled to a refund as a result of, any service outages that are caused by our maintenance on the servers or the technology that underlies our sites, failures of our service providers (including telecommunications, hosting, and power providers), computer viruses, natural disasters or other destruction or damage of our facilities, acts of nature, war, civil disturbance, or any other cause beyond our reasonable control.
